Terms of Service

1. Acceptance of these terms

By accessing or using Pipeline, you agree to these Terms of Service and our Privacy Policy. If you use Pipeline for a company or other organization, you represent that you are authorized to accept these terms for that organization.

2. What Pipeline does

Pipeline helps authorized users manage leads, customers, appointments, estimates, contracts, photos, invoices, payments, jobs, field notes, calls, messages, and related business records. A signed construction proposal, contract, or change order controls the construction work itself; these terms govern use of the software.

3. Accounts and responsibilities

• You must provide accurate account information and keep your sign-in credentials confidential.
• You are responsible for activity under your account and for telling us promptly about unauthorized access.
• You must have permission before adding another person’s contact information, photos, files, or communications.
• You are responsible for reviewing estimates, contracts, messages, prices, taxes, payment amounts, and customer details before relying on or sending them.

4. Google and other connected services

Pipeline may connect to Gmail, Google Calendar, Twilio, Stripe, Brevo, Resend, OpenAI, Replit, and other services when enabled. Your use of those services is also subject to their own terms. We are not responsible for third-party outages, rejected messages, delayed synchronization, payment decisions, or changes to third-party services.

5. Customer communications and records

Authorized users control which customer communications are sent. Pipeline may log delivery, opening, signing, payment, and similar status events for business records. You are responsible for complying with email, text-message, call-recording, consumer-protection, contracting, licensing, and privacy laws that apply to your communications and projects.

6. Payments

Payments may be processed by Stripe or another enabled payment provider. Pipeline records payment status but does not store full card or bank-account numbers. Payment authorization, settlement, refunds, disputes, chargebacks, and payout timing are subject to the payment provider’s rules.

7. AI-assisted features

Dictation, translation, summaries, classifications, and drafted content may be generated or assisted by automated systems. These features can make mistakes. You must review important output before sending, signing, pricing, scheduling, or relying on it. Pipeline does not provide legal, tax, accounting, engineering, or other professional advice.

8. Acceptable use

You may not use Pipeline to:

• Break the law, send unlawful spam, harass someone, or violate another person’s rights.
• Upload malicious code, interfere with the service, probe security controls, or access data without authorization.
• Copy, resell, reverse engineer, or misuse the service except as allowed by law.
• Send false, deceptive, fraudulent, or misleading estimates, contracts, invoices, or payment requests.

9. Your data

You retain ownership of the business and customer information you submit. You give Don Howard Construction and its service providers permission to host, process, transmit, display, and back up that information only as needed to operate, secure, support, and provide the specific Pipeline features you use. Information received from Google APIs is not used for advertising, unrelated profiling, sale, or generalized AI-model training.

10. Service availability and changes

Pipeline is provided on an “as available” basis. Features may change, and maintenance, third-party outages, network problems, or security events may interrupt access. We do not guarantee uninterrupted service or error-free operation.

11. Disclaimers

To the fullest extent permitted by law, Pipeline is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Don Howard Construction will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption. Our total liability arising from Pipeline will not exceed the greater of one hundred dollars ($100) or the amount you paid us to use Pipeline in the twelve months before the event giving rise to the claim.

13. Suspension and termination

We may suspend or end access to protect the service, investigate misuse, comply with law, or address a material violation. You may stop using Pipeline at any time. Certain business, payment, signed-document, and legal records may be retained as described in the Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. The “Last updated” date identifies the current version. Continued use after updated terms are posted means you accept the updated terms.

15. Governing law and contact
